1. Who we are

This website is operated by Play Academy Foundation, Inc., a Florida nonprofit corporation with its principal address at 10760 Brunello Pl #206, Wellington, FL 33414. In these terms, “we”, “us” and “the Foundation” mean Play Academy Foundation, Inc. “You” means anyone who uses this site.

The Foundation has applied for recognition of exemption under section 501(c)(3) of the Internal Revenue Code. That recognition has not yet been granted. Nothing on this site should be read as a representation that it has been.

Program delivery is carried out under contract by Play Academy, a separate company whose certified coaches operate in residential communities. Play Academy is not a party to these terms, and its own agreements govern the services it provides.

2. Using this website

You may use this site for lawful purposes only. You agree not to:

• Use the site in any way that interferes with its operation or with other users' access to it
• Attempt to gain unauthorized access to any part of the site, its servers, or connected systems
• Scrape, harvest, or systematically extract data from the site by automated means without our written permission
• Impersonate the Foundation, a coach, or another user, or misrepresent your affiliation with us
• Upload or transmit malicious code

3. The PLAY Standard licence

The PLAY Standard curriculum documents published on this site are made available at no cost under the following terms.

You may

• Download, store, print and copy the documents
• Use them to coach, teach, parent, or supervise children, whether or not you are affiliated with the Foundation
• Quote from them in academic, journalistic, or evaluative work with attribution
• Share the complete unmodified documents with others at no charge

You may not

• Sell, licence, or charge any fee for the documents themselves
• Remove our name, marks, or attribution, or present the material as your own
• Rebrand the curriculum, or publish a modified version of it under any name
• Offer paid training, certification, or accreditation in The PLAY Standard without a written licence from us
• Represent that a program, coach, or organization is affiliated with, endorsed by, or certified by the Foundation when it is not

Charging a normal participation fee for a sports program that happens to use the curriculum is not “charging for the documents” and is permitted. Selling the curriculum as a product, or selling training in it, is not.

We keep all copyright and other intellectual property rights in the curriculum, the Play Academy Foundation name and logo, and the site's design and content. This licence grants you the permissions described above and nothing more. We may end it if you breach these terms.

4. What the curriculum is not

The PLAY Standard is character education material for use by adults supervising children in sport. It is written to be useful, not to substitute for professional judgment. Specifically:

• It is not medical, psychological, therapeutic, or nutritional advice, and it does not diagnose or treat any condition. The health literacy module teaches general concepts and is not individualized guidance for any child.
• It is not a safety system. The water-safety standard in Document 08 sets a minimum we hold ourselves to; it does not replace qualified lifeguarding, supervision ratios, facility rules, or applicable law.
• It does not transfer responsibility. If you use this material, supervision of the children in your care, compliance with the law, and the safety of your program remain entirely yours.

If a child needs medical, psychological, or emergency care, contact a qualified professional or emergency services. Do not rely on this website.

5. Program participation

Enrolling a child in a program is governed by a separate registration agreement, waiver, and health and media consent forms provided at the time of registration. Those documents control if anything in them conflicts with these terms. Nothing on this site is an offer of a place in a program or a guarantee that a program will run in your area.

6. Donations

Donations are voluntary and, unless we state otherwise in writing, non-refundable. If you believe a donation was made in error, contact us and we will review it in good faith.

Tax deductibility. The Foundation's application for 501(c)(3) recognition is pending. Until the IRS issues a determination letter, we cannot tell you that a contribution is tax deductible. If recognition is granted, it is ordinarily effective retroactively to the Foundation's date of formation, but that outcome is not guaranteed. Please consult your own tax advisor. We will issue an acknowledgement letter for every donation regardless of status.

We describe how gifts are used in good faith. We reserve the right to direct funds where the need is greatest if a stated purpose becomes impractical, and we will tell donors when we do.

7. Your submissions

If you send us feedback, a correction to the curriculum, a story, or any other material, you grant us a non-exclusive, royalty-free, worldwide licence to use it in our work, including in future versions of the curriculum. You confirm the material is yours to give. We are not obliged to use it, keep it confidential, or pay for it. Do not send us anything you consider confidential or that contains another person's private information.

8. Third-party links

This site links to other organizations, research, and government resources. We do not control those sites and are not responsible for their content, accuracy, or privacy practices. A link is not an endorsement.

9. Disclaimers and limits

The site and the curriculum are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that the curriculum will produce any particular outcome for any child.

To the fullest extent permitted by law, the Foundation and its directors, officers, employees, volunteers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or the curriculum. Our total liability for any claim relating to this site will not exceed one hundred United States dollars.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

10. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.

11. Changes

We may update these terms. We will change the “last updated” date above, and for material changes we will post a notice on this page for at least thirty days. Continuing to use the site after a change means you accept the revised terms.
